@UConnBallknower @krystalball You do get the opportunity to apply for a green card, which she did. Legally. And was in the final hearing for her green card (which took 5 years to get) when ICE arrested her. Reading is fundamental.

@krystalball Yes, she was ordered deported in 2018. You don’t get a magic I get to break the law card because you decided to get married after you were ordered deported.

Marrying a US citizen doesn't automatically change legal immigration status or override an existing deportation order. It allows filing for a green card (like the I-130 her husband submitted in 2020), but the 2018 order led to her detention. She may need to bond out and petition to reopen the case. ICE detain wife of U.S. Marine—separate her from 2 young kids. She was at her final immigration interview that she waited 5 years to get—when agents burst in and arrested her right in the middle. "I served the country, and you know, I would think that the country would serve us," said Corporal Patrick Baja. "We followed everything to a 'T' to do things the 'right way' in the process... As a Marine veteran, I would just like some help." Diana Butnarciuc left the Eastern European country of Moldova claiming political asylum in 2008—has two children, works, and pays her taxes. She is currently locked up away from her family at the Henderson ICE Detention Center in Las Vegas, Nevada. #DemsUnited

@cronengod @LongTimeHistory The original post omits that Diana Butnarciuc has a deportation order from 2018, stemming from her 2008 asylum claim. This led to her detention during the green card interview, despite a 2020 I-130 petition filed by her husband.

@LongTimeHistory You don't get to cross an entire ocean to claim asylum. And you can't retroactively request asylum if you missed the initial window to file for it.

@LongTimeHistory Court hearing was to decide whether to deport her. It sounds like she started the process of requesting to be allowed to stay 5 years ago, after she had been in the USA 13 years. She was singled out for arrest for another reason.

@LongTimeHistory A fundamental question: is the wife staying in the US with legal status? If not, it doesn’t matter who her husband is, the ICE has the legitimate reason to take action. Being a marine does not mean his wife can go above the law.

@LongTimeHistory You know if the person had entered our country legally, with all of their paperwork, they would still have to wait for the people who didn’t to enter legally.,,,

@LongTimeHistory why these assholes bury the lead. She was oredered deported in 2018 after her asylum claim was denied. The petition for green card was in 2020 after the deportation order was issued already. You cant come here illegally, marry a citizen and expect it to go away

@LongTimeHistory They own a cleaning service for luxury real estate properties in Las Vegas, say it with me now. They could have resolved the 2018 deportation order. No one is above the law.

@tuskaliscous @rewSWVA @LongTimeHistory No. She’s not. She is a DOCUMENTED immigrant with standing to receive permanent residence. Never committed an illegal act, has a husband and two children who are American citizens. She works and pays her taxes. Stop lying about her legal status.

@dddfaber @rewSWVA @LongTimeHistory She's an illegal alien and had a deportation order. Her marriage is irrelevant and only allows another pathway to citizenship. Does not make her a citizen.

@LongTimeHistory You neglect to mention her asylum claimed was denied in 2018 and was ordered to leave. She quickly got married to change her status.

@LongTimeHistory She has a standing deportation order. This isn’t complicated. Not sure why you choose to leave that out?
