Outstanding job by @PerianneDC on @MorningsMaria with @MariaBartiromo discussing how @elonmusk and @VivekGRamaswamy’s @DOGE may want to push for merging the @CFTC & @SECGov. There’s a strong case to be made for merging the two agencies. Merging the SEC & CFTC would eliminate duplicative oversight, reduce inter-agency conflicts, and provide a unified framework for regulating securities and derivatives. This would simplify compliance for market participants, especially as financial products increasingly blur the lines between securities and commodities. There’s no better example of this inter-agency conflict (ie “turf war”) than digital assets. Financial markets have evolved significantly, with complex instruments like swaps and crypto-assets falling into gray areas. A single regulator would be better equipped to handle the overlapping responsibilities that currently require coordination between the SEC and CFTC. A merged agency could provide uniform rules and protections for investors and market participants, avoiding confusion caused by differing approaches to enforcement, rules, and market oversight. A consolidated regulator would align the U.S. with other countries that typically have a single financial market authority, potentially enhancing the U.S.’s ability to compete in global financial markets. Another area DOGE should consider for consolidation: PAYMENTS Here’s the federal agencies involved in payments: 1) @federalreserve: with FedNow; 2) @USTreasury: including combatting illicit financial activity; 3) @CFPB: enforcing consumer protection laws; 4) OCC: supervises national banks and federal savings associations, including their payment activities and grants special-purpose charters to fintech companies involved in payments; 5) @FDICgov: supervises state-chartered banks that are not members of the Federal Reserve System and allegedly ensures the safety and soundness of banks engaged in payment activities; 6) @SECGov: regulates payment systems associated with securities transactions, including clearing and settlement mechanisms; 7) @CFTC: oversees payment systems used in commodities and derivatives markets, particularly regarding clearinghouses; 8) FinCEN: enforces AML KYC and counter-terrorism financing (CTF) regulations related to payment systems and regulates non-bank payment providers, such as money transmitters and cryptocurrency exchanges; 9) @TheNCUA: supervises and regulates credit unions that participate in payment systems; 10) @FTC: enforces laws against unfair or deceptive practices in payment systems, including for non-bank providers and oversees payment processors and emerging payment platforms like fintech and peer-to-peer (P2P) services; 11) OFAC: administers and enforces economic sanctions, including restricting payments to sanctioned entities; 12) @FCC: regulates telecommunications-related payment systems, such as mobile payment platforms and billing services provided by telecom companies; 13) @SBAgov: The facilities access to payment systems for small businesses, particularly through lending programs and grants; 14) Even the @USPS is involved in payments through the issuance of money orders and other programs. Crypto provides a great example for the need of consolidation: In 2014 @USGAO described XRP as a “virtual currency utilized in a decentralized payment protocol called Ripple.” The following year, FinCEN entered into a settlement with @Ripple, declaring XRP a “virtual currency” forcing Ripple to comply with U.S. Banking laws. The SEC was made aware of the settlement in 2015 but had been aware of XRP since 2013 when @chrislarsensf gave a presentation before many of the above agencies. FIVE years AFTER the FinCEN settlement, and after XRP had been publicly traded for over 7 years, the SEC suddenly declared XRP a security, causing more than $15 billion in losses to investors. @DOGE’s TIME HAS COME
