Racism in the Supreme Court In the death penalty case McCleskey v. Kemp, Justice Scalia wrote a memorandum to the other justices saying that he did not need additional proof that racism motivated the jurors to impose the death penalty. He also said that knowing that racism motivated the jurors and, thus, prosecutorial discretion, should not require reversal of the sentence.
