Dear Justice Carpio, with all due respect — your "House can just subpoena AMLC for bank records" hot take is not bold constitutionalism. It's a **blueprint for abuse** dressed up as accountability.
The House Committee on Justice is **NOT a court**. It's a preliminary panel, basically a fiscal deciding whether to file charges. Its job? Evaluate the evidence the complainants actually submitted — not play detective, dig through AMLC's massive database of every suspicious transaction in the country, and "improve" a weak case.
Yet here we are: complaints screaming "unexplained wealth" and SALN issues without naming **a single bank account**, **a single bank**, or attaching one concrete transaction. Zero particulars. Just vague vibes and recycled old claims. And Carpio says "sure, let them subpoena AMLC anyway!"
Retired Justice Adolfo Azcuna already called it straight: this is "**bordering on a fishing expedition**." The committee isn't clarifying — it's on a treasure hunt, hoping to fish out something, anything, to prop up the complaints. That's not probable cause determination. That's a **mini-trial** and a due process nightmare.
AMLC doesn't just hold Sara's data — it has eyes on **everyone's** large and suspicious transactions. Handing that kind of power to a politicized House panel with zero tight relevance requirement is an invitation to selective harassment. Today it's the VP. Tomorrow? Anyone who becomes inconvenient.
RA 1405's "cases of impeachment" exception isn't a magic wand for unlimited snooping in the preliminary phase. Historical practice proves it: in Corona, Estrada, and others, deep bank/AMLC dives happened (if at all) in the **Senate trial** — the actual judicial "case" — not this early fishing stage.
Carpio's theory doesn't strengthen impeachment. It **poisons** it. It turns a solemn constitutional process into a weapon for political vendettas, violating privacy, due process, and the Bill of Rights. Grave abuse of discretion in robes.
Supreme Court, do your job if these overbroad subpoenas escalate. Protect the Constitution from being twisted into a blank check for dragnet investigations.
Impeachment should expose real wrongdoing — not empower lazy complainants and eager panels to go on unlimited safaris through private financial lives.
