Oh man, Naheed Nenshi just mentioned the "supremacy of the courts" like it’s some sacred constitutional principle that trumps everything. Buddy, we have parliamentary supremacy in Canada, not judicial supremacy. The Charter literally has a Section 33 notwithstanding clause so Parliament and/or provinces can tell the courts “thanks, but no thanks”. There is no such thing as “supremacy of the courts". Never has been. The courts interpret laws, while elected legislatures make (and can override) them. That’s Canadian Civics 101. Nenshi out here acting like the Court is somehow the final boss of democracy instead of, you know, the people and their representatives. Imagine thinking unelected judges get the last word.... forever. Stay in school, Naheed. Or at least read the Constitution before you run for Premier.
