A crucial point here. The unconstitutionality of the directive goes even far deeper than just the Code. It violates the very essence of our constitutional dispensation: the separation of powers. A law cannot be changed by Ministerial directive, only Parliament can amend laws.

@zilevandamme I agree with your positioning around following a legal process, no short cuts. The draft directive requires ICASA to amend it's regulations to align them with the sector code. It does not require amendment of the sector code. ICASA' regulation is stricter than the sector code.

@zilevandamme Aware of an Indian court making such a judgement and the views of local lawyers, so would be interested in a link to local case law pls. Would think there would at the least need to be some notification to the admin to establish knowledge of unlawful content + take down request.

A quick cautionary message to admins of WhatsApp groups where disinformation is disseminated. South African case law provides that both the author of a post & an administrator of a group bear responsibility in the chain of publication. Got R500K lying around? A word to the wise.
