@sdcilaw This situation has little to do with the s. 8 right concerning unreasonable search or seizure? Their possessions aren't being seized & tents aren't being searched, they are just removing the encampments— and by extension, their homes— altogether. #OJENROEJSP22 @OJEN_ROEJ

Some may claim that this is against their section 8 Charter right. Which states that “ Everyone has the right to be secure against unreasonable search or seizure,” if the government has a fair reason to do so, it's within their power.

For the city to evict someone in a proper manner they must have a reason to do so. I believe that the city has the right to evict whomever they want from the tent encampments, but within certain and appropriate meanings. #OJENROEJSP22 @OJEN_ROEJ

And by forcing eviction without safe and proper alternatives, we are majorly encroaching and impairing on their fundamental right to security of person. (2/2) #OJENROEJSP22 @OJEN_ROEJ

#OJENROEJSP22 @OJEN_ROEJ But if the circumstances and conditions in shelters remain as they are currently, then in turn this by-law must be struck down as a result of infringing on the pressing and substantial right to life, liberty, and security of the person under s. 7.

#OJENROEJSP22 @OJEN_ROEJ If we want to continue to uphold the right to evict tent encampments from public spaces, then we must provide appropriate and adequate shelters and housing for these individuals that are safe, comfortable, sanitary and easily accessible.

(1/6)If a city should be able to evict people living in tent encampments is a complex issue. The by-law NO. 05-099 states that the city “is authorized to remove… any unauthorized… encroachment from any park by any means”. #OJENROEJSP22 @OJEN_ROEJ @ProvostLaw
