And here’s the biggest issue👇 ⚠️ In my client's case, the same person conducted both the investigation and the disciplinary. That’s not in line with ACAS guidance. Different managers should handle each stage to ensure fairness. Otherwise, the outcome risks being prejudged.

In a few months, they’ll find better opportunities, rebuild their confidence, and thrive elsewhere. But they’ll never forget how you treated them — How you shouted, humiliated, and misunderstood them, simply because your ego got in the way of basic empathy. They might never speak about it. But they’ll carry the scars — silently. Power should never come at the cost of someone’s dignity.

The planned removal of the cap on compensatory awards for unfair dismissal is hugely significant. Currently, the award for a successful unfair dismissal claim is capped at one year's salary or £118k (whichever is the lower). Removing this cap makes it very worthwhile for claimants to pursue claims for higher compensatory awards. This obviously has an impact on claims from high earners, but it goes beyond them. For example, someone in their sixties on £50k per year arguing that the intended to work for at least 5 further years but unlikely to get work - without the cap, they could seek compensation for £250k (5 x £50k). Imagine how Davidson v National Express Limited [2025] EAT 151 might have been reconsidered under an uncapped regime.
