The owner of Smash House in Lakewood/Toms River defends his store selling the Kosher cheeseburger with a reference to Shulchan Aruch, Yoreh De'ah 87:3. The Rema there writes: "ונהגו לעשות חלב משקדים ומניחים בה בשר עוף, הואיל ואינו רק מדרבנן. אבל בשר בהמה, יש להניח אצל החלב שקדים משום מראית העין..." Translation: The custom is to make "milk" from almonds and place poultry meat in it, since [poultry in (real) milk] is only rabbinic. However, with red meat (beef), one should place almonds next to the almond milk because of marit ayin (creating a false impression). If almonds (or clear pieces/evidence of almonds) are visibly placed in front of or with the almond milk, it removes the marit ayin concern — people see it's not real dairy.
