The primary source documents from Paolo Contini, Legal Adviser to the United Nations Special Mission to Somalia, provide clear evidence that the 1960 “union” between Somaliland and Somalia was not a lawful act of statehood but an irregular and defective arrangement contrary to international legal standards. The Commission expressly concluded that the laws adopted in June 1960 the “Union of Somaliland and Somalia Law” and the Act of Union (attio di unione) were “legally defective and could not be regarded as having the force of law for the whole Republic,” with the “legal consequences of the Union” remaining uncertain. To fill this void, a new Act of Union was drafted by the Commission and adopted by the National Assembly in January 1961, but it was applied retroactively to 1 July 1960. This practice is contrary to fundamental principles of international law. Retroactive lawmaking cannot create or validate state sovereignty where none legally existed. The Vienna Convention on the Law of Treaties (1969), while adopted later, codified a long-standing principle that treaties and acts of union require valid consent of the contracting parties at the time of formation (Articles 11–18). A union of sovereign states must be constituted through mutual ratification of a treaty of union or through explicit referenda demonstrating the free will of the peoples concerned. In this case, no such legal instrument was ever ratified by both states. The only referendum held in June 1961 was on the Somalian Constitution, not on the union itself. By conflating a constitutional referendum with consent to union, the process violated the principle of self-determination of peoples (affirmed in UN General Assembly Resolution 1514 (XV) of 1960). Somalilanders were thus denied their right to freely and directly determine their political status, a violation that renders the claimed union void ab initio under international law. Accordingly, the so-called union between Somaliland and Somalia cannot be regarded as a valid international act but only as a de facto annexation, imposed through retroactive legislation and without the lawful consent of the people of Somaliland.

How many people does it take to link Ilhan Omar to an Al-Shabaab commander? Just one and she danced with him. - Ilkacase Qays. This Somali rapper, deeply embedded in Minnesota Democratic and Somali community circles, was photographed with Abdi Madobe — a Senior Al-Shabaab commander leading roughly 200 fighters in Somalia’s Sool region. According to the UN Security Council Panel of Experts Report S/2025/777 (November 28, 2025): “Another 200 [fighters] are operating under the leadership of Abdi Madobe, a long-serving senior commander in the region, in the south of North-East State [Sool region].” Abdi Madobe has operated as a key military commander in SSC-Khatumo forces (Somalian militia) in that same Sool region. Last week in Minnesota: The same Ilkacase Qays was entertaining at this Kenyan business/community event in MN — Ilhan Omar is actually dancing with a terrorist sympathizer following her speech at the event. That’s a short influence chain: Local rapper with documented ties to a terror commander → performing at an event with a sitting U.S. Congresswoman. This raises serious national security and ethics concerns — potential foreign influence, unvetted access to elected officials, and risks of terror-linked networks reaching into U.S. politics. The Al-Qaeda affiliate Al-Shabaab has been advancing its positions in Somalia for more than a year now and has reversed most of the territorial gains made by the Somali Federal Government during its 2022–2023 counteroffensive.. Al-Shabaab's launched its massive "Operation Ramadan" in February last year and have been on the move ever since, recapturing vast portions of south-central Somalia and now control around 30% of Somalia’s territory. By establishing a dominant strategic triangle in central Somalia (across Moqokori, Tardo, and Buq-Aqable), Al-Shabaab has effectively re-linked its northern and southern support zones for the first time in years, allowing them to sever government supply routes. They are also getting closer to Mogadishu and have captured several villages and key choke points within 40 to 50 kilometers of the capital city. They can now disrupt arterial roads and easily launch vehicle-borne improvised explosive devices (VBIEDs) into the city center. In late 2025, an Al-Shabaab suicide squad successfully stormed a branch of the National Intelligence and Security Agency in Mogadishu, demonstrating their ability to hit heavily fortified strongholds of the federal government. The Mogadishu government’s military forces have also been weakened recently due to the forced departure of UAE’s military instructors under Saudi pressure as Saudi Arabia weaponized its direct financial aid to the Mogadishu government by conditioning budget support on Somalia cutting ties with Abu Dhabi. On January 12th this year, the Somali government passed a resolution annulling all security, defense and maritime agreements with the UAE. This decision applied retroactively to federal institutions and all regional member states, ordering the immediate termination of UAE operations at the Gordon military camp as well as major commercial port hubs in Berbera, Bosaso and Kismayo. The UAE opened the General Gordon Military Training Camp in May 2015 as part of a multimillion-dollar commitment to rebuild the Somali National Army and launch tactical counter-offensives against Al-Shabaab. The camp serves as the premier installation for recruiting and screening elite cadets for the Somali National Army. Cadets undergo foundational assessment at General Gordon before being deployed to international partner installations in Uganda and Ethiopia for advanced tactical training, subsequently returning to the base as active-duty units. The camp functioned as the nerve centre for Emirati and Bahraini officers tasked with rebuilding Somalia's security architecture All three ports have ignored the federal government’s orders to cut ties with the UAE as they are located in the self-declared state of Somaliland (Berbera), the semi-autonomous state of Puntland (Bosaso) and the autonomous state of Jubaland (Kismayo). The federal government in Mogadishu has no physical or military control over these areas, making it possible to keep the ports open and protecting the UAE's investments. The spat with the federal government about the ports’ future has seriously strained Puntland’s and Jubaland’s relations with Mogadishu, making security cooperation against Al-Shabaab even more difficult. With the increased territorial control by Al-Shabaab, the country’s already weak infrastructure is crumbling with maintenance and repair works not being able to be carried out in vast swaths of territory.  The Islamist terrorist organization now has around 12 000 terrorists under arms and hopes to be able to launch more attacks on Mogadishu in the coming months.

Somaliland will be recognised in days, weeks, or months. When exactly? I don’t care. I won’t be pressured into obsessing over the exact timing of when it happens. Better to prepare content for the moment Somaliland recognition is trending and more eyes are on us. The date and timing are implementation details. Every country has hundreds of calculations and interests that can change at any moment. But the destination is one: the full and final recognition of Somaliland and its success.
