Prosecutors and defense attorneys say it’s a bad idea. And it runs counter to extensive work from a judicial task force of criminal pretrial proceedings. One-size-fits-all is rarely the right answer when thousands of cases are passing through our courts every day. 3/x

This is one example. The Senate heard considerable testimony against the bill. And hadn’t moved it. At the end of the session, deals happen. Replacing a bill with something altogether different lessens public scrutiny, public input, and full legislative consideration. 2/x

This procedure is a serious problem in Kansas: “On the final day of the 2026 Legislature’s regular session, early Saturday, the House and Senate replaced the contents of House Bill 2651, an unrelated bill, with HB 2610 and sent it to Gov. Laura Kelly.” 1/x

I agree. @ManoRajuPD is absolutely doing the right thing by standing up for the ethical caseloads his public defenders and their clients deserve. The crisis in PD funding across the nation is catastrophic and it takes brave leaders like him to say no more. #FundPublicDefense

It’s a huge problem when states rely too much on assigned counsel to handle indigent defense. States don’t pay enough, causing a shortage of willing lawyers & unconstitutional delays in appointment. For more on the problem & solutions, check out: papers.ssrn.com/sol3/papers.cf…

Last I checked, law school tuition and the cost of living are not going down. Yet next year, in MA, bar advocates will be paid **$85/hr** to represent defendants in district court. Doesn't seem like a recipe for the continued existence of lawyers for poor people.

Out of funds, Maine’s public defense agency can no longer pay contracted lawyers newsfromthestates.com/article/out-fu… Unfortunately this headline could come from a lot of states. Adequate & stable funding for public defense is a constitutional imperative.
