#FreeJaprado Dr Austin Omondi AKA @Dr_AustinOmondi has been abducted while running a blood drive campaign at the Sikh Union. A car plate number KCU819H is reported to have been used. We ask the DCI & National Police Service to swing into action and find and release Dr Austin Omondi. Austin had expressed anxiety yesterday evening following his participation in organizing medics to take care of injured people during the #RejectFinanceBill2024 demonstrations on Thursday. He reported that he received calls from unknown numbers threatening to kill him on Tuesday if he appears to provide medical services for demonstrators. Dr Omondi is part of the team called Medics For Kenya that is coordinating management of injuries during #RejectFinanceBill2024 demonstrations that also includes young doctors from @KenyaMedics_KMA Young Doctors Network (YDN) led by @KristinMutonyi & @kipkoechkevin7 that has incorporated nurses, clinical officers and other medical cadres. They had their base at Jamia Mosque this Thursday and plan to have more bases on Tuesday at All Saints' Cathedral Nairobi. Dr Omondi had helped get twenty stand by ambulances in case of any eventuality. #FreeJaprado is the # we are using to look for him. This is a new phase of the ongoings. KMA, @lawsocietykenya , @AmnestyKenya @DefendersKE and other non-governmental organizations had issued a joint statement yesterday outlining the dangers of limiting freedom of speech and unlawful detentions of Kenyans expressing themselves. We urge Kenyans to come out in numbers first to Search for Dr Austin Omondi AKA JaPrado, and to condemn arbitrary arrests of Kenyans.

MY UNSOLICITED ADVICE TO PRESIDENT WILLIAM SAMOEI ARAP RUTO ON THE IMPASSE IN THE DOCTORS’ STRIKE. Dear Mr. President, I know I mean nothing to you. I know your supporters will come on this space to throw insults at me for writing this. I did not vote for you on August 9th 2022, but I am a Kenyan and you are the President. I know the effects of the Doctors’ strike. These men and women are loyal to their union. KMPDU is there voice and whatever they say is what they do. Mr. President, in the evening of November 2013, my mother fell sick. She had never been sick for the time I had known her. She got ill at the time Doctors were on a nationwide strike. My family and I ran up and down to seeking for medical help. All government and county hospitals were no-go zones; there was simply nothing happening there. The only available medical facilities in our neighborhood were private hospital, most of them run by the church like Lugulu Mission Hospital. My mother needed specialized medical care, only available in government facilities, but this was not to be. The whole of December, we were moving from one hospital to another, with minimal attention. Finally when the strike was called off in January 2024, we took our mother to the Moi Teaching and Referral Hospital in Eldoret. We had a sigh of hope, but it was too late. She passed on. Mr. President, threats to doctors by your people including the police will not help solve the problem. Doctors are loyal to their UNION. Mr. President, the statement by the IG of police Mr. Japheth Koome is not making things better. Neither are the reckless remarks by people like Government Spokesman @MwauraIsaac1, governors threatening to sack doctors and others. As Rosalynn Carter said “A leader takes people where they want to go. A great leader takes people where they don’t necessarily want to go, but ought to be”. Be the great leader and take the bull buy the horns. Call a meeting of all stakeholders in the health sector and together with KMPDU officials, sit down on a round table, speak as a leader and you will be listened to. President Daniel Arap Moi (may he RIP) did it in 1997 with teachers, and it was successful. A return to work formula is what the Doctors want, make them hole and think. But having your people dismiss the CBA that was signed in 2017 as a mere paper won’t help solve the impasse. Intern Doctors are not like other interns in other professions, they do a lot of work, they save lives, they spend sewing rotten wounds, helping mothers to deliver successfully and many others. Mr. President, thank you for reading from me. God Bless Kenya.

DEBUNKING THE CBA 2017 - 2021 The CBA 2017 -2021 signed between the union @kmpdu & @MOH_Kenya & @KenyaGovernors council of governors was negotiated under mediation of a neutral party for three months i.e. between March and June 2017. CBA negotiation committees from all parties were constituted as a requirement of the Return To work Formula signed on 14th March 2017 when the 100 days strike was called off. The MOH CBA negotiations meeting were held at the ministry’s headquarters while the 47 county CBAs at the council of governors headquarters. The spirit of the CBA is well captured in the preamble: under free and voluntary association, in the interest to promote sound industrial relations, economic well being of the workers and the employer and overall improvement of healthcare service delivery in the public health sector. THERE WAS NO DURESS as alluded to by the government. Under Article 1 - Terms of the Agreement, the agreement was effective 1st July 2017 and would remain in force until amended or renewed. This compels the government of the day to enforce it, any enforcement out of this agreement that is unilateral and non-consultative not only violates the agreement but is null and void. Under Article 3 - On training, development and Research. The ministry is required to avail an annual training budget set a minimum of two percent (2%) of its annual recurrent budget as provided for in the ministry policy. Under the 4th schedule of the constitution, training is a function of the National government. Internship and post graduate specialisation fall under this function. Internship is further outlined in the Kenya Medical Practitioners Council Act {CAP 253} as a prescribed period of employment during which a medical or dental undergraduate works under supervision to fulfil registration requirements under a temporary internship license. These provisions apply to pharmacist interns under the Pharmacy and Poisons Board ACT { CAP 244}. The Interns are required to sign a 1 year contract of employment specifying terms and conditions of service and duration of internship. Article IV - Remuneration Entry into public service for graduate medial doctors as per the scheme of service has been historically at Job Group L. In 2015 - 2016, the @srckenya conducted a job evaluation survey across the public sector and placed intern doctors in the category of Band C which translates to Junior management and high level skilled officers/ Skilled and advanced operational staff. This exercise was the basis for remuneration of doctors from the junior most I.e. intern to the senior most I.e. specialists in the CBA 2017 - 2021. Interns have enjoyed the perks for the last 7 years. The basic salary for all doctors in the CBA 2017 - 2021 was recommended by the @srckenya . By 2020, it had not been implemented and the union filed a case in court, Cause no. E6464 of 2020. All parties to the suit argued their positions in the employment and labour relations court, the judgement issued in October 2021 compelled the government to implement this clause within 60 days. In conclusion, the CBA 2017 - 2021 was well structured and thought out as per government guidelines and regulations and the laws of the land. Its overarching principle was to restore industrial harmony in the public health sector and enable the country achieve Universal Health Care {UHC} which requires a well paid, trained and motivated workforce. By reneging on the implementation of the CBA, the government of Kenya is sabotaging its own agenda of attainment of UHC.
