On this NUPENG Vs DANGOTE issue, there are two sides to the story and we need to look at it dispassionately.
- Section 40 of the Nigerian Constitution guarantees the right to freely assemble and associate.
- Section 1 of the Trade Unions Act (TUA) expressly provides the right to form and join trade unions:
- Section 9(6) of the Labour Act protects workers from being compelled to join or refrain from joining a trade union:
- ILO Convention 87 (Freedom of Association and Protection of the Right to Organise) and ILO Convention 98 (Right to Organise and Collective Bargaining). Both ratified by Nigeria.
- The Trade Dispute Act prescribes a process to be followed before a strike can be called.
When you analyse these four laws and 2 conventions, what immediately becomes clear is the following;
DANGOTE
Dangote's actions by allegedly making the 4,000 newly recruited truck drivers to sign undertakings not to join any trade union, forbidding them in the process;
- Contravenes Section 40 of the Constitution (freedom of association).
- Violates Section 9(6) of the Labour Act, since the company is imposing a condition of employment.
- Conflicts with international standards (ILO Conventions 87 & 98), which Nigeria has ratified.
NUPENG
NUPENG's action of insisting that the truck drivers MUST be unionised, also contravenes Section 40 of the Nigerian Constitution.
However, they do have a constitutionally guaranteed right to protest and a legal right to go on strike, which must follow due process under the Trade Disputes Act. The TDA requires referral to the Industrial Arbitration Panel or National Industrial Court, exhaustion of conciliation/mediation channels, and lawful strike notice. Otherwise, the strike could be deemed illegal. If none of this have been done, then the national strike on Monday can be deemed Illegal.
Personally, (and this is me speaking as a Nigerian), I am with DANGOTE all the way and quite frankly fed up with the stranglehold NUPENG and it's members have on the downstream. But whatever is done must be done within the limits of the laws otherwise we become a lawless society.
I believe and convinced that there is enough provision within the Trade Disputes Act for both parties to exhaust and come to some meaningful resolution.
