@lambpie1st @ArmandoNDK The obama admin, like the bush admin before it, was also putting border crossers in jail for 8 USC 1325 violations and then removing them. This just increased the number of people who entered with children. Operation streamline was created in 2005.

@ArmandoNDK How do you get a judicial warrant to arrest somebody for a civil offense? Immigration was purposefully made part of the executive branch, not the judicial branch. For a lot of very good reasons. The first four words of the sixth amendment are "in all criminal prosecutions".

Immigration court is not a criminal court and it's not an article III court. You can't get a judicial warrant from an article III judge without evidence of a crime or criminal intent.

The “temporary” by law means until the conditions in the country which led to the designation have resolved. If conditions haven’t improved, the law says TPS must be renewed for another 18 months. Congress specifically designed the law to *insulate* the decision from politics!

Immigration judges are not judges in the way most people think of judges, they are immigration attorneys that work for the executive office for immigraton review.
