Every person has the right, peaceably and unarmed, to assemble, to demonstrate, to picket, and to present petitions to public authorities. Article 37 of the Constitution of Kenya. Many school going children did not go to school today. Many judicial officers did not attend Court physically. Many road users kept off our roads due to notices served online on protests against hike in fuel prices. The right to protest, picket and assemble (peaceably and unarmed) as guaranteed by the Constitution of Kenya cannot be over emphasised. The same right should however be used sparingly so as to protect our economy, justice sector and proper functioning of our institutions. We should not hurt ourselves more as we savour our rights.

I am glad the protest has been suspended.Goons and robbers have retreated. The guns have gone silent. The protest was very successful. It has shaken the Country to its very foundations. The whole country grounded to a halt. Many day schools were shut down.Lives lost. Many were injured.Massive property destroyed. The economy has suffered. The protest could have been avoided. We do not have another country. It should not happen again. Let us all come together and find a middle ground.

1. Tea Levy introduced by the Government against tea exports and imports should be abolished immediately. 2. 0.8% on exports will hurt tea farmers more. Our tea will be very expensive and less competitive. 3.The Government should reestablish lost markets in Sudan, Chad , Iran etc. 4.County Governments should hire agricultural extension officers who should advise farmers on the best agricultural practices. 5.Tea is the 3rd largest foreign exchange earner and that is good enough for the Country.Cartels should not be allowed to kill the sector.

Enhanced fuel price hurts everybody in Kenya and an urgent solution is needed. The Poor suffer more because of increased inflation that will eat into their income. Those who have pulled out their vehicles as a protest are protected by the law. They should be protected and engaged on the way forward.Goons, robbers, hooligans and hoodlums who have taken advantage of the turmoil to obstruct others, destroy property, maim and or kill should be arrested forthwith and Charged in Court. We have one country that we must preserve and conserve.Nobody will give us another country.Meanwhile, the Government should not issue threats but find a middle ground on the fuel crisis.Suspend some taxes as the Global crisis hopefully abates Soonest.

Kenya School of Law (KSL) plays a critical role on matters governance and the rule of law globally. KSL instructs lawyers and paralegals not only on the law but also professional ethics and conduct. This afternoon,we had a short interaction amongst the board, management and the staff. We appreciated the role played by the management and staff in shaping the legal profession in terms of instruction on the law and professional ethics and integrity. Our Country yearns for men and women of integrity. People whose word is their bond. People who stand for justice, human dignity, fairness, equality and equity.

We shall overcome because the arc of the moral universe is long but it bends toward justice.” -Dr. Martin Luther King Jr., “Remaining Awake Through a Great Revolution”. Speech given at the National Cathedral, March 31st, 1968. In 2011, six Kenyans were dragged to court and charged with hindering burial of a dead body contrary to section 137 and 36 of the Penal Code cap 63 Laws of Kenya. After a blistering hearing,Hon. Gerald Mutiso acquitted the accused persons for want of a case to answer under Section 210 of the Criminal Procedure Code. In 2014, they mounted a petition in the High Court for appropriate compensation. They pleaded that they were pawns in a political Chess game in Rongai where the security apparatus was being misused. The Attorney General mounted a strong defence but upon introspection, Prof Joel Ngugi J,as he then was, found that the Petotioners' rights were violated. He also found that Public officers who go out of their official remit to abuse others shoulder personal responsibility. He then awarded each Petitioner kes. 800000 with interest and cost. The Court of Appeal dismissed a subsequent Appeal with costs to the Petitioners.Warsame JA,Mativo JA and Gachoka JA struck another blow for the rule of law and bill of rights. The decisions by the Court have satisfied my soul. That the poor have rights that can be vindicated by the Court. That the bill of rights in our Constitution is not a pious of platitudes. That some of our courts still function and they can bite if moved accordingly notwithstanding the appurtenant delay. I was happy to see the Petitioners, some in their 80s, receive a portion of their compensation. May justice be our shield and defender.May we have more judicial officers who cherish our bill of rights.May Justice be served upon the poor and the rich.

Article 48 of the COK guarantees the right to access justice at the least cost possible. The state bears that responsibility. Article 49 abhors pre-charge or pre-trial detention as well interpreted in @HonOscarSudi vs Republic by Prof Joel Ngugi and several other cases. There should be no detention beyond 24 hours. Arrests before conclusion of investigation should be minimal and should attract bond unless there are compelling reasons. A holistic approach to the Constitution means that Courts in Kenya should function for 24hrs throughout as Courts are like hospitals and the military. They are the last line of defence for human rights. The CJ should immediately engage other stakeholders and operationalise Courts that run throughout the day the whole year. That means like medics and soldiers, judicial officers should enjoy functional health. A judicial officer who is unwell should be given time and support to recover. He should not be pushed to work and deliver outside good health. Yet Nakuru Law Courts has had a judge who is unwell. He pleads for support and understanding from the sick (litigants) in the open court for over a year now. He needs support but outside work as he hurts himself more by working while sick. He hurts the litigants more as he cannot deliver rulings on time. The judge suffers. Justice suffers more. The judiciary must now device away of treating judicial officers who are unwell outside Court. A very doctor can treat a sick person. A very sick policeman cannot deal with criminals. Sickness is human. We are all frail. Worse, a person is arrested by the police on Friday like the kamata kamata Friday. He is taken to Court on Monday 13/4/2026 and an application for further detention to allow for FORENSIC examination of his phone is made. Never mind he has no control over a confiscated phone. He is detained for 14 days by a magistrate who works for the police. An intervention is made to the High Court on 17/4/2026 under a certificate of urgency. Nothing happens upto 20/4/2026 when the assigned Judicial officer laments that he is overloaded and unwell. Nothing has happened upto now.The suspect might spend 14 days in a police station and released thereafter without a charge. Travesty of justice. That is why I urge the CJ and Judicial Service Kenya to smell the coffee and model a judiciary that functions 24 hours with judicial officers with military efficiency and functional health otherwise Kenyans might decide to close the Courts and use the services of politicians and witch doctors to resolve their cases. .

Kefogo, Ainamoi, Kericho I visited the families of Kefogo residents who have been unjustly denied title deeds to their rightful land in Chelimo Kefogo. Unverified allocation list, has well-connected and undeserving individuals, including companies owned by the high and mighty. The indigenous residents have been left out, suffering in silence. Some are very old, widows and/or indigent. I called upon the PS Lands and County leadership, led by the Governor to urgently address blatant injustice affecting our people. They should provide the primary list and issue titles in accordance with the same. I urged the elected and appointed leaders to shun untrammeled greed and avarice. They should withdraw land given to their friends and relatives who are not deserving.Companies cannot be squatters.
