A major catalyst for this dispute is the revelation that Davao City 1st District Representative Paolo "Polong" Duterte received a staggering ₱51 billion allocation for regional flood control projects during his father Rodrigo Duterte's presidential administration. Critics note that despite this massive funding, Davao City continues to suffer from severe flooding.
Serving as the Chairman of the Senate Blue Ribbon Committee, Marcoleta spearheaded a high-profile Senate investigation into these anomalous flood control contracts. He faced intense public scrutiny for defending and pushing to grant immunity to the Discaya couple under the Witness Protection Program (WPP), arguing that threats to their lives made it necessary and that returning stolen funds should not be a requirement for their protection.

'DID YOU BELIEVE HER?'
NEWS ALERT: Senator Alan Peter Cayetano pressed NBI Regional Director Jeremy Lotoc on whether the NBI actually believed VP Sara when she said she had already contracted a person to kill President Ferdinand R. Marcos Jr., First Lady Liza Araneta-Marcos, and former House Speaker Martin Romualdez.
"Did you believe her?" Cayetano asked — to which Lotoc initially answered: "Well, she's the Vice President, sir."
Cayetano followed up, noting that VP Sara had also invoked freedom of expression in relation to her statements, asking whether the NBI believed her on that count as well, and pushing the witness to clarify the basis of the investigation's conclusions.
Lotoc stressed that the NBI's conclusion that VP Sara's threats were serious and real was based not on whether they believed her personally, but on the evidence gathered during the investigation.
"Based on what we gathered, sir, no," Lotoc said when asked whether the NBI simply took VP Sara's word for it.
Cayetano also raised the question of whether VP Sara's statement—"kapag pinatay ako, patayin mo silang tatlo"—could be read as a self-defense mechanism rather than an offensive threat.
He noted that VP Sara herself identified Marcos, Liza, and Romualdez as the people she believed would have her killed, and asking whether the NBI had investigated that dimension of the case.
"I don't know the state of mind of the Vice President," Lotoc answered.
Cayetano challenged Lotoc's response, noting that the witness had spent the entire afternoon testifying about going into VP Sara's state of mind based on the series of events and her statements.
"We based everything on the evidence that we've gathered," Lotoc stressed.
