I'm enjoying how many people have revealed that they could not possibly pass the bar. The answer to this so intuitive, too. There's no mutual assent. This isn't like two guys agreeing to play poker, this is a guest assuming the host is a casino when he's not. The casino knows if I put in a quarter and win, I get the jackpot, otherwise the casino keeps my quarter. Here, the host didn't agree with that. It's his house and he owns the equivalent of a box filled with quarters that randomly opens. He invited guests to play with the box, not to open it. He has no obligation to pay this man $700 if the box randomly opened. At best, the guest should get his quarters back if he was legitimately stupid enough to assume that the host was running an illegal casino without a license in his own residential property.
