Five days after Menlo-Atherton High School’s @TheMAChronicle filed their copyright claims against me, the #KillingAmerica trailer remains down from @Vimeo and @YouTube. And since Friday, the full film remains down on both sites. In addition, the Chronicle has not retracted their cease and desist letter sent to me last Tuesday. Posted below are two screenshots of @TheMAChronicle’s explanation, after the fact, trying to explain away their actions. Two takeaways here. 1) They make no mention of the Fair Use doctrine which allows copyrighted footage to be used without permission. YouTube explicitly asks one to consider Fair Use before filing a DCMA claim. M-A Chronicle claims to provide “objective coverage” but they can’t even do that here. Their omission of Fair Use is intentional and misleads the public. As journalists, they know better but chose activism over their duty. 2) The Chronicle states in the below post that their editorial board “made this decision without communicating with or being influenced by M-A administration.” Who is the editorial board? Students? Minors who are not legally allowed to file claims? Why didn’t the journalist teacher advisor, John McBlair, fulfill his educational responsibilities here re Fair Use? This is a clear attempt by the administration to distance itself from this issue. But the fact is that the administration and district are responsible for this publicly funded paper. Now that the administration and the district — which has activists throughout who were exposed in my film — know about the actions of the minors why haven’t they taken any actions to retract the false claims against me? Remember, minors cannot legally file such claims and minors are not the copyright holders of said publicly funded materials. The district’s School Board led the charge to remove the honors classes over the past 8 years. The principal of M-A High, Karl Losekoot, slammed the film without seeing it. And on. These people are not without severe biases and their motivation to stop this film is more than clear. But I will not change one frame of this film and will continue to fight to expose the full rot within this district and school.
