Look at the R v Oaks case where SCC established criteria around applying the reasonable limits clause (s.1). The SCC most certainly can interpret use of s.33 and create criteria to apply it.

@lm_walker2000 @gjbangar @nationalpost No that's NOT how things go, you need a constitutional amendment, to add or remove things from this part of the Constitution. The SCC can't interpret something that doesn't give it that power in case of Section 33.

The true significance of case is how the SCC decided to view and implement the limitation clause -section 1 of charter. They can & have interpreted the spirit of constitutional law and will do it again here.

@PatriotNorth1 @nationalpost Foolish comment and revealing. The SCC can examine the spirit of the law, and they have numerous times. They don’t have to amend the charter, they can create guidelines for use and interpretation of intent of law as they did with limitations clause in R v. Oaks case.
