Defamation is very different from cyber bullying. It was the court’s decision to prosecute for cyber bullying not the claimant. He sued for defamation and was okay with the a retraction and a fine. But the court had a duty to protect the child who was the victim here. Kudos!

Again, you see this cyber bullying trap that you people are boldly walking into, it will go round. You have successfully established that people can spend 2 years in jail for internet posts. You will regret this. I promise you. We will be here. Adekunle Gold is a public figure who had invited the entire public to his private affairs, including his home, marriage and children. There’s no reason on earth anyone should be jailed for making comments about them. Wishing death or declaring death on someone is not a criminal offense. It is not, and can never be. People don’t die because you declare them dead. If it worked that way, Tinubu would have been dead long ago. It is the duty of Adekunle Gold to protect his family from the internet. It is not the duty of the Nigerian judiciary. The Nigerian judiciary does not exist to protect celebrities and their families, it exists to try criminals.

A dollar billionaire wakes up to find false news on his marriage ending and his daughter contacting HIV. He’s a man with a global reputation to protect so he takes step available within Nigerian law. Option one, he sues in tort for defamation and demands for 5 billion. After 12 months of litigation, court awards 100 million with apology letter in 5 national dailies and 3 international papers. The accused can’t afford to pay 100 million. Even 10% of the fine will destroy the family of the accused. Certainly, billionaire can’t garnishee. So he either accepts a moral victory or gets a committal order for the defaulter to be locked up. Option two, he petitions the State to prosecute by virtual of Cybercrime Act 2015 which stipulates a maximum of 3 years and/or a fine of 7 million for intimidation, harassment, incitement, etc. Now, bear in mind that bear that the victim is a billionaire with a global reputation. What would the court consider adequate remedy for the victim? The full fine of 7 million naira plus some apology in newspapers or imprisonment? Also bear in mind that the accused woke up, and decided to concoct terrible lies that can damage the public standing of a billionaire and harm his digital foot print, and the life of his daughter. What would the judge consider adequate deterrence, especially when the accused posted these falsehood in the hope of making money off its potential virality and shock value while being fully aware that the post is false and ignoring repeated admonitions to delete from well meaning observers? In this case, what would be justice for victim, the state, and the accused? Also, what would be sufficient deterrence? Would an apology suffice? Would 6 months of community service be sufficient apology? Would retracting the defamatory statement be enough to restore the image of a man with a global profile?
