Since all that most people know is that @Mashinsky pled guilty and they assume that — based on what people like @camcrews, @SimonDixon, the @WhiteCase attorney Aaron Colodny and their goons are saying — @Mashinsky pled guilty to some massive fraud and running a Ponzi scheme and looted his company, let’s set the record straight. Here is the truth as set out by the government in their Sentencing Memorandum dated Monday, April 28, 2025. Screenshots attached of Count 2 and Count 5. “At the outset of the plea hearing, the Court placed Mashinsky under oath and confirmed that he understood that any false or untrue answers could be later used against him in a prosecution for perjury or making a false statement. Plea Tr. 3. The Court described the allegations and elements of Counts Two and Five, and Mashinsky confirmed he understood. Plea Tr. 10-16. When asked to explain his conduct with respect to Counts Two and Five, Mashinsky stated: ALEX MASHINSKY: “Your Honor, as to Count Two, in December 2021, in connection with the Celsius Earn Program, part of which included electronic sales of the commodity Bitcoin in exchange for the CEL tokens that were used to pay customer rewards, I gave an interview in which I suggested that Celsius had received approval from regulators even though I knew that was not true. “I understand at the time that customers would likely find false comfort in that misrepresentation, and that it would be material to their decision to invest in the Earn Program.” ALEX MASHINSKY: “As to Count Five, in September of 2019, I intentionally failed to disclose that I was selling my CEL token holdings even though I represented to the public, using electronic communications and wires, that I was not selling. I understand at the time that customers would likely find false comfort in that misrepresentation, and that it would be material to their decision to purchase or sell CEL token as an investment contract. “I was working in the Southern District of New York as a CEO of Celsius at these times. I know what I did was wrong, and I want to try to do whatever I can to make it right. I accept full responsibility for my actions.” Those are the two things @Mashinsky pled guilty to under oath and he was speaking to the Judge at the time. Anything else is a blatant lie. This is public information. You can do a google search or a ChatGPT or Grok search and go look for yourself, but I assure you that I’m not lying. Honestly, I thought the government had more than two misstatements to charge @Mashinsky with based on what Assistant US Attorney Damien Williams said at his big public press conference when he indicted and arrested @Mashinsky on July 13, 2023, mainly that @Mashinsky ran one of the biggest crypto frauds in history and comparing him to @SBF_FTX; but here we have the government saying we are charging @Mashinsky with two misstatements that he made, one made in 2019 and one made in 2021. That’s the only comment I’ll make here. Every one of us is free to compare what Assistant US Attorney Damien Williams said in July 2023 when he arrested and indicted @Mashinsky and what Assistant US Attorney Damien Williams eventually charged @Mashinsky with and asking the judge to sentence @Mashinsky on.
