The CCP Has Infiltrated Local, State and Federal Governments The Arcadia City Council supermajority this week censured Mayor Sharon Kwan, but a last-minute stay by the council allowed Kwan to retain her duties and powers as mayor, pending a further vote from her colleagues, if they deem future conduct unacceptable. A formal stance of disapproval against Kwan was approved with a 4-0 vote on Tuesday night, Sep. 2, with Kwan abstaining. “I hope everyone can respect and allow me to do my job as the mayor of Arcadia,” Kwan said. The action was carried over from the last council meeting, where after two hours of public comment and over four hours of debate, the council fell short of reaching a decision on censure and whether to relinquish Kwan of key mayoral duties — the authority to lead council meetings, handle committee assignments and speak publicly on behalf of the city. Talk of censure first arose during the Aug. 19 regular meeting, where the authenticity of Kwan’s Memorial Day speech was a contentious subject. Following the disagreement, and after Kwan reiterated months-old concerns of sexual harassment, Councilmember David Fu made a request to hold a special meeting where censure would be on the table. The resulting resolution outlines a laundry list of Kwan’s alleged misdeeds, ranging from implying financial corruption by city staff to “planting audience ‘trolls’” to disrupt council meetings. Before the censure was approved, councilmembers and the mayor clashed on multiple accounts. Kwan attempted to override a majority council vote to prioritize the censure item during the meeting. And up until the censure vote, there was a back and forth on whether Kwan could initiate witness testimonies during the meeting to defend herself against the allegations. “I have to understand all the evidence that’s provided. I have not finished with the comments,” Kwan said during the meeting. “I assert at this point that you are out of order,” Fu responded. “It’s not on the agenda and it constitutes a violation.” The council voted 4-1 against the enabling witness testimonies. The public comment period, they said, was visited at the last meeting and has since expired. It was Fu himself who in the end motioned that the censure be adopted subject to an amendment that essentially allowed Kwan to retain her authorities and duties, including the ability to preside over council meetings, retain her committee assignments, and speak on behalf of the city. But moving forward, if Kwan commits an action disapproved of by the council, as it relates the behavior that led to the censure in the first place, then she remains subject to the relinquishing of her mayoral duties. Also on the agenda was a resolution to guide how council members should hold themselves while in office. Previous councils followed informal, unspoken rules of decorum such as “treating everyone with respect” and “actively listening to other viewpoints,” which the new resolution’s 25 pages put in ink. Arcadia council members serve four-year terms and rotate the mayorship every 9 1/2 months. With the exception of Councilmember Paul Cheng, the city’s elected representatives are serving their first terms on the dais. The mayoral censure, made halfway into Kwan’s mayorship, marks the first time Arcadia city council has formally rebuked one of its own members.

Very weird that cover page states "On Emergency Application to the Supreme Court of Virginia." That's the styling for a petition for a writ of certiorari, but it makes no sense to say that the emergency application is "to" the Supreme Court of Virginia.
