@Nick_BPSS @2AvSagas Right, I think there’s a totally colorable argument that she had no remaining discretion. I just think the “easiest” winning argument here is the arbitrary/capricious one. But both are on the table.

@michaelcpollack @2AvSagas I’m all for putting it to the test of what her rationale was because it’s important to know but I think even if she slapped together a fake study that said “here are bad economic effects” that wouldn’t give her the power to do this anyway if that makes sense.

@2AvSagas @Nick_BPSS Sub “not arbitrary/capricious” for “rational basis” but yeah. I’m not saying she necessarily does have that latitude, but even if she does, I still haven’t heard a reason that clears the bar.

@Nick_BPSS This is more @michaelcpollack's area of law than mine, but I think the argument is that if Hochul's rationale is that she has the right to do this subject to some rational basis, you need to actual show what that rational basis is.
