Ancient Rome was famous for its laws; how about Ancient China? Before the Warring States Period (475–221 BCE), the two main schools of thought on governance were 帝道 (無為) and 王道 (德治). The first promoted non-interference in people’s lives, letting the natural order flow. The second emphasized empathy and believed human nature was good. After years of wars, kind but non-fighting people were culled while the fierce survived. The Warring States Period saw more than 5% of the population killed directly in slaughter, and mass graves can still be seen today in Shanxi province. Governance gradually shifted toward militaristic states that used laws to centralize power instead of distributing it among nobility. There were three goals: - Centralize power under the king, as many states at the time were splitting power among establishments that were not incentivized to change. - Promote grain production and taxation efficiency, as wars were purely driven by the supply of food and men. - Abolish inheritance of nobility titles and reward based on military achievements, so that the state would have unlimited men for wars. Sweeping reforms known as 商鞅變法 led to the rise of Qin. Other states adopted similar reforms less thoroughly, fearing overthrow by their own establishments. Qin, the weakest and on the brink of collapse, had nothing to lose. On centralizing power: - Laws stated that the king held absolute power, no matter how ridiculous. Citizens had no right to doubt or express opinions and owed unquestioning obedience. - All activities and exchanges required real-name identification (similar to 實名制). - Reporting law violations was encouraged; failure resulted in execution. - Violating orders led to execution of entire villages (連坐, collective punishment). - Executions were extremely cruel, ranging from being torn apart by five horses to chopping off noses or hands or tattooing faces for lighter offenses. - Executions of 700–800 people a day were normal; rivers ran with blood for days. This absolute terror transformed society to stop questioning the laws and focus only on compliance. On promoting productivity and taxation efficiency: - All able-bodied people were dedicated to farming and military service, while other industries were discouraged or banned. - Nobility lands were redistributed to private citizens, and taxes were introduced on private lands. Before this period, farmers kept all grains from their private lands but worked assigned time on nobility lands. The government noticed far lower production on nobility lands because farmers cared less for them. Thus, nobility lands were redistributed and taxes on private properties introduced. On abolishing nobility inheritance and rewarding military achievements: - Nobility lands could no longer be inherited without capturing enemy heads. - Capturing enemy heads was rewarded with land, official ranks, housing, and slaves. This gave lower classes a path to rise while higher classes had to keep proving military success to retain ranks. It gave Qin almost unlimited men willing to die in wars. Yet such reforms had weaknesses. While they enabled Qin’s quick rise, this approach could not govern in peacetime. Within just 15 years after Qin conquered China, it fell because people could not endure the tyrannical laws, especially collective punishment. But the spirit largely remained in later dynasties, where the law was the king and the king was the law. There was a famous exchange: “漢家自有制度,本以霸王道雜之,奈何純任德教,用周政乎!” from the 10th emperor of Han, who lectured his son that a king had to be both cruel and kind to govern. That set the governing style for the next thousand years.
