Nebraska’s AD confirmed that if the CSC does not clear the resubmitted deals that were the subject of the recent arbitration hearing, the Nebraska AG will step in to challenge the CSC/NCAA. The state law says athletes & schools can’t be penalized for athletes being paid NIL $.

There's already a cause of action for knowingly recruiting/soliciting someone to break their contract. It's called tortious interference. But the real concern should be the intent to restrict mere communication about future employment. Chilling speech seems very anti-American.

I LOVE this. We should be spreading stories of athlete empowerment, saving money, and strategizing for future success as opposed to focusing on conflicted and salty Nick Saban arguing for a salary cap without athletes having a seat at the table.

@heitner As more colleges hire former pro sports execs, specifically for football, you will see more and more complexities especially those familiar with the older style nfl contracts with multiple performance tiers and bonuses that can be unlocked.

Over the past week, I have reviewed dozens of #NIL agreements across the country. The market continues to mature, but certain issues keep surfacing in negotiations. Here are some of the things I'm finding: Payment structures have grown far more sophisticated. I'm seeing more hybrid deals that combine guaranteed upfront payments with performance bonuses tied to specific deliverables and some deals that contain no guarantees whatsoever. Any non-guaranteed income could leave athletes chasing money they were orally promised. Termination clauses remain the most heavily negotiated provision. One-sided, "sole discretion," termination rights without notice or cure periods are concerning. Post-termination rights and IP ownership remain areas of emphasis. I specifically look for "perpetual" and "irrevocable" grant of rights or extended licenses in my review. Athletes should want rights (other than limited archival rights) to expire cleanly when the deal ends. These are real business contracts with real dollars and real consequences. Athletes and their advocates need to treat them that way. The deeper the NIL industry develops, the more important it is for athletes to retain experienced counsel to walk them through every material term before signing.

The change to NCAA bylaws which allows schools to not enter athletes into the portal if a rev-share agreement releases the school from the obligation hasn’t gotten enough attention. Schools can now essentially prevent athletes from engaging with other schools during the portal.

Don’t be surprised if lawsuits are filed relating to the decision to not grandfather athletes into the NCAA’s age based eligibility rule. It’s similar to the situation after NCAA rules allowed Alston awards (Hubbard case) & NIL pay (House case). Tough spot for the NCAA.

Because most people aren’t patient enough to wait until the product is better. A few years ago the UFL was just another spring ball eye roll but now it’s getting more exposure. Since it’s something unique and different, more people will complain to get their own attention. 🙄

Someone help me understand this: Why are some people be SO against the UFL or other Spring leagues? It's football sooner than later after CFB and NFL is over. Why wouldn't anyone want more football to watch or attend? I never understood the hate.
