Smith "I would say that it is a single judge who's made a decision and we have now 700,000 Albertans, whether they're on the remain side or the leave side, who've said that they want to have this public debate." "...I'll listen to my caucus and I'll listen to my cabinet because we are the duly elected representatives of the people of Alberta and this is a decision by one judge at a lower court level and it's appealable. And so because we think they have been incorrect in law, we will be appealing it." "we think that there may have been an error in law made here because the duty to consult has been interpreted normally when you're talking about a specific project like a pipeline project, which is what we're doing right now in consulting on a west coast pipeline route" "...This is not clear and so that's why we think it may be incorrect in law and why we will be appealing it. " "The proponent of that petition always intended for it to go to a referendum... so that is what the committee is grappling with right now since he seemed to have flip flopped and changed his mind after the fact." @ABDanielleSmith

In this interview the former Alberta Premier Jason Kenney wants to see “action” against the separatists. He says they are destroying the Country & wrecking Alberta’s economy. It’s funny that’s exactly how the separatists feel about the Liberal Government who have destroyed our Country & all but ignored the people of Alberta while benefiting from their economy. This is what panic looks like.

The media will spin this as a major blow. It isn’t. Do you really think we didn’t expect a liberal-appointed judge from New Brunswick to try to block this? Danielle Smith can call the referendum herself. Now she must honour the clear democratic will Albertans showed.

@s2kaway @MargTokar @TheBreakdownAB A citizen led initiative doesn’t need to consult them. Guess what else? This is all just going to piss more Albertans off and bring more support to the independence cause.

BREAKING!!!! A judge has ruled that the Elections Alberta CEO’s issuing of the separatist petition was a violation and the decision to issue that has been quashed. The push to have an illegal petition has killed itself! #abpoli #ableg #cdnpoli

Nothing will stoke Alberta separatism more then having an unelected judge telling them they can't leave Canada.

@sillyrabbitfafo @JSJamato Ah, but over 400k signed the forever canada petition, which if approved could trigger a referendum too. Dumb thinking on Tommy’s part

#BREAKING A judge has quashed the approval, by Elections Alberta, that started the separation petition. Lawyers for Athabasca Chipewyan First Nation say this means the independence referendum cannot happen, at least under this question. #ableg #cdnpoli

🚨 BREAKING: A liberal-appointed judge just blocked the democratic will of 300,000+ Albertans who signed through the Citizen Initiative Act process to put Independence on the Oct. 19 ballot. Danielle Smith must use her authority, listen to Albertans, and let the people vote.

My read of Justice Leonard’s decision: it does not block an Alberta independence referendum. It says Bill 14’s transition rules did not revive the citizen petition route. A secession question should be initiated by Cabinet under the Referendum Act, with First Nations consulted before the vote in case Treaty/traditional rights are affected. The lawful path now rests with the Smith government to set the independence question for October 2026 (just like the SCC envisioned in the court's 1998 Secession Reference case).

OFFICIAL STAY FREE ALBERTA STATEMENT CONCERNING THE RECENT JUDICIAL DECISION ON THE STAYFREE ALBERTA INDEPENDENCE PETITION : “We disagree fundamentally with the decision which appears on its face to violate principles of natural justice and contain numerous errors of law. We have been instructed to prepare and file the appropriate appellate documents.”

Lawyer @ikwilson says this ruling only affects petition-driven referendums -- and the premier can still call one herself. Given that 700,000 Albertans have already signed petitions calling for referendums (one for, one against) it would be undemocratic for her not to do so.

@JSJamato She has to put a question on the referendum. Over 700,000 albertans signed petitions for a question on staying or going

All eyes are now on what Alberta's premier does. Will she try to put another question on the ballot? She told me earlier this week her gov't is considering it, pending this case. #ableg #cdnpoli
