5️⃣ The two positions capture a genuine and unresolved tension in our law. On one side, procurement rules must be strictly enforced, or they mean nothing. On the other, a public entity cannot weaponise those same rules to escape paying for work it asked for and benefited from. The Court of Appeal has, for now, favoured the second, holding that fairness and finality prevail where a public body has already taken the benefit. But the deeper question, how to punish procurement breaches without rewarding a public entity’s own bad faith, is one the courts will keep facing. Where the accountability for an unlawful variation should ultimately fall, on the contractor, the officers who authorised it, or the entity itself, remains the harder question beneath this judgment.
We continue to monitor developments in procurement and arbitration law and their implications for public entities and contractors, and will share updates as the position develops.

2 Regionalna Baza Logistyczna w Warszawie wybrała ofertę Lubawy na dostawę zestawów minersko-rozpoznawczych (sprzęt saperski dla wojsk inżynieryjnych).
💵Łączna maksymalna wartość: 50,8 mln zł netto (62,5 mln zł brutto).
Dla porównania, analogiczna umowa z tym samym zamawiającym z 2024 roku opiewała na 42,9 mln zł netto. Ta jest wyraźnie większa.
Jednakże, spółka sama zaznacza, że tylko 50% tej kwoty to wartość GWARANTOWANA (czyli ok. 25,4 mln zł netto). Pozostała połowa to zamówienia opcjonalne, prawo, a nie obowiązek zamawiającego.

Solidarity has warned that the draft regulations issued under the Public Procurement Act fail to address the root causes of South Africa’s public procurement crisis. The organisation also questions why the regulations have been published for public comment before the Constitutional Court has ruled on the constitutionality of the Act itself.
Solidarity has submitted its comprehensive comments on the draft regulations to the National Treasury.
