The only hospital in my region is preventing me from ordering outpatient studies from them because im on medical and personal leave from taking in-house call for them because of my asthma exacerbations in the hospital but I can still continue full time with my private practice. Any law firms or watchdog legal group who can help me? They tell me if I give up my privileges or drop to courtesy staff they'll allow me but I dont want to do that because they'll probably make it difficult fir me to get my full privileges back because they likely want to get rid of all competing private practices in the region especially a vocal and community Advocate like myself

Patients need to know that they are free to choose their imaging providers. It is illegal for a health system to require captured physicians and APPs to order scans exclusively within a system. Many physicians are too afraid to resist the illegal directives. Patients need to insist on finding the best imaging centers with on-site radiologists and happy, helpful staff and ultra modern equipment.

Why We Need an Outpatient Diagnostic Acccess Act I find myself in a position I never expected. I am still seeing patients. I am still performing surgery. I am still actively practicing medicine on Maui. Yet I can no longer directly order certain outpatient diagnostic studies and biopsies for my own patients through the local hospital system. How did that happen? Beginning around October 2025, I developed increasingly severe asthma symptoms that were consistently triggered by the hospital environment. During hospital work, I required multiple inhalers, repeated courses of oral steroids, and ongoing medical treatment. Outside the hospital environment — in my office and ambulatory surgery center — I remained able to safely practice medicine and perform surgery. Eventually, the steroid treatment contributed to a gastrointestinal bleed. I requested and received an approved medical leave from hospital duties while continuing my outpatient surgical practice. I never stopped caring for patients. I never stopped operating. I never stopped practicing medicine. What changed was my ability to directly obtain certain hospital-based outpatient diagnostic services for the people under my care. No one informed me before my leave was approved that this would occur. As I worked through the issue, I discovered something even more concerning: my situation was not unique. Many Hawaiʻi residents assume that when they visit a licensed physician, surgeon, midwife, or other healthcare professional, that practitioner can order the tests necessary to diagnose and treat them. That is not always the case. Across Hawaiʻi, there are healthcare professionals who hold active state licenses, practice within their legal scope, and care for patients every day, yet face barriers when attempting to order certain outpatient hospital-based diagnostic services. A behavioral observation worth sitting with. If you ask a hundred independent business owners whether they would cooperate with their direct competitors to lower a shared cost, the answer is almost universally no. If you ask the same hundred whether they would cooperate with their non-competing peers in the same town, on a category that does not touch their differentiation, the answer is again no, but for a different reason. The first no is strategic. The second no is unexamined. This matters because almost everything that bleeds an independent business is a Category Two cost. HR. Payroll. Property insurance. Cyber. Benefits. Compliance. The categories where pooling is fully legal, fully sensible, and would change the cost structure within a renewal cycle. They are not refused on principle. They are refused on inertia. “This is the way we do it” is doing more economic damage to American small enterprise than any policy environment has managed in fifty years. The competitors most independents are afraid of are not the ones across the street. They are the consolidators who pooled all of this a generation ago and now write the checks.
