@GenZMultifamily Most states require you to exercise reasonable diligence to re-rent the property and, when that happens, the early terminating tenant’s liability ends. That could take days or weeks or months. Often, tenants want to close the loop and will pay a fee to terminate early.

How do you guys handle a tenant who wants to break a lease? I know life happens and making someone pay out an 18 month lease is harsh and unlikely. Usually, I will allow the tenant to break it and only have them pay the next month of rent to find a new tenant. Is that reasonable or am I being too nice?

I know this is admitting I'm terrible at business perhaps, but I don't care. I really never charge for quick .1 or .2 emails. Everyone has my cell and I never charge for texts. There are a lot of little status updates. I try to only charge for substantive legal things. This keeps my client's super happy of course. Yes, I don't collect a ton of money because of this.

@AMandoSch Know your judge and advocate accordingly. Build your attorney capital with the judges you see often and use it intelligently. And when you are on the cusp of telling a judge to GFT, be ready to retire or pause and rethink that emotion. I stopped practicing in DC for that reason.

I have had the urge to get very aggressive in Court lately in a lot of my hearings (for good reason). I have not done so really and I'm currently at a stage where I am constantly juxtaposed between holding back or going for the throat on verifiable claims in order to expedite matters and cases. It's scary. I want to be bold, but I also don't want to get whacked down. Always reading the room and trying to push the boundaries. Thus far, remaining quite conservative however.

Legal Aid and others are now a constant presence in Rent Court, using all manner of technical defenses - license numbers, housing code - to dismiss cases or delay them.

For 25 years landlord-tenant law was the same. Eviction firms took $1000 to file paperwork and 90% of cases went unopposed. 5 years ago in covid everything changed. Now most evictions are contested. Tenants and tenant lawyers have adapted and gotten better. Millions are poured into eviction defense by the city and county. Eviction lawyers are still practicing like its 2019. Still charging pennies to work on volume and giving penny-type service. Attorneys practicing evictions for 20 years and don't know the code. The rules means that tenant lawyers play the game with cheat codes and I play the game on hard mode. It is what it is.
