The irrationality of the $100,000 H-1B fee implemented is that it applies even to individuals who already reside and work lawfully in the United States on a lawful visa status. For example, a professional may already be contributing to the U.S. economy, pursuing a PhD while on F-1 visa, and then elects consular processing for the H-1B rather than change of status, perhaps to complete academic research, satisfy visa requirements, or transition in an orderly manner. Under this framework, that same worker faces a $100,000 penalty merely because of the procedural route chosen, not because of any lack of merit, compliance issue, or economic harm. That is not rational policy. It is an arbitrary barrier imposed on talent America already has, already vetted, and already benefits from. Make it make sense.
