I’ve shared some thoughts on what the Trump administration could mean for crypto and wanted to also recognize the XRP family’s patience and unwavering support. A lot has happened since XRP was the 2nd most valuable digital asset. It’s been - at times - a frustrating journey. ~6 years since the SEC started meddling in the crypto market, picking winners and losers… ~4 years since the SEC sued Ripple… and now FINALLY we see a light at the end of the tunnel as these external (frankly unnatural and manipulative) market factors fade. Initial thoughts on the SEC Appeal: 1. Big mistake by the SEC. It will appeal the programmatic sales ruling and IF it wins, it will get more money from Ripple and have protected no one. Ripple will raise its "Blue Sky" law issue and, if it wins, the SEC's ability to regulate the entire Crypto space is essentially destroyed. Not a good calculation of risk by the SEC (it would make a poor stock trader). 2. This is an appeal by right (not like when the SEC tried to appeal before), the trial Judge can't reject the appeal. 3. The SEC is very very likely to lose, both statistically and based on the fact-heavy way the Judge wrote her opinion. 4. Even IF the SEC were to "win" on appeal, it's very very likely just a matter of money - nothing would change as to XRP and its use by Ripple. 4. In a couple weeks we'll know what issue(s) the SEC is appealing and then it must file its first brief by mid-December. It will NOT (and cannot) be appealing that "XRP is not a Security." Importantly, watch for whether the SEC is appealing the injunction. 5. A ruling from the Appellate Court won't happen until late 2025/early 2026. I posted it would take until Summer 2025 a couple months ago - I was wrong about that sorry! 6. I refuse to believe that Attorney Grewal announcing he's leaving the SEC the same day the appeal is filed is just chance. But I'm kooky like that. 7. The only hope of this all being over soon is if there's new leadership at the SEC. If Trump becomes President again, I will humbly accept the role of Director of Enforcement and refocus the agency on protecting you from scams, frauds, and thieves.

Long story short, the SEC is crying.. but here is also the long version: The SEC opposes Ripple's motion to dismiss the testimony of Andrea Fox, who they used as a summary witness in their case. Ripple claims Andrea Fox provided expert testimony, which should have been disclosed earlier, but the SEC argues that her declaration is simply a summary of Ripple's financial records and doesn't constitute expert testimony. Her declaration involves basic arithmetic applied to financial data to help clarify the amounts discussed in court. The SEC notes that Fox’s declaration only uses documents provided by Ripple and makes simple calculations based on this data. The declaration is similar to another one previously accepted by the court, despite Ripple's similar objections. The SEC believes the court should deny Ripple's motion to strike Fox’s declaration because it doesn't involve any specialized accounting knowledge or expert opinions, just straightforward math calculations from provided financial records. Additionally, the SEC mentioned that Ripple had the opportunity to challenge this declaration earlier through discovery processes, like depositions and requests for information, but did not do so. Well, if you’re still with me today then you’ll know my $XRP price opinion expired as of midnight last night. Well, I refuse to believe that because still to this day, I know what I hold. What other digital assets have gone through such scrutiny and unjust circumstances but continues to prevail and still sits in the top 10? I can’t think of any other #DigitalAsset other than XRP.
