The decision has been released (see our previous shared post for links) now we await the sentencing portion of this case, which is expected to come sometime in July.
As previously mentioned, this case is one of the most important legal battles in Canadian policing history.
The verdict decimated centuries of how police investigate and has now established new precedent where police officers must ask permission when investigating those who are deemed “public officials” or when the investigation may have “political and societal ramifications”.
The fall out from this decision will be detrimental to policing.
This will undermine police independence which is a core principle of democratic policing.
Investigators need to make operational decisions independent of political pressure, which is the very definition of political influence.
It will ensure that a different set of rules apply for those in power, creating unequal treatment under the law. Anyone who is being investigated should be subject to the same investigative standards.
All of this further erodes the public’s trust of law enforcement.
Which is not something the policing community can afford.
Detective Grus and her council, Bath-Sheba van den Berg have already indicated they will be appealing this decision.
