Tesla has officially submitted an application for FSD Supervised under Article 39 of EU Regulation 2018/858. This is a special procedure for innovative tech that doesn’t yet fully fit existing rules, to secure early approval.
In the March 2025 TCMV minutes (EU Technical Committee on Motor Vehicles), one Member State asked about the status of this application for full self-driving supervised ADAS.
The request was filed in May 2025 through the Dutch RDW, with testing in the Netherlands and Norway since June 2025 – but unfortunately, it has been delayed due to bureaucracy and strict requirements.
Current status (November 2025):
• Limited testing approved in NL, NO, DE, FR, SE, ES (since July 2025), but only for employees and not on highways.
• EU-wide vote delayed; now hoping for late 2025 or early 2026.
• No public release yet – Elon Musk calls it “mission critical” but frustratingly slow.
