@RiotDogChicago I do a lot of title litigation, so frequently our properties end up part of a bankruptcy estate, or the debtor will file to avoid a foreclosure. It makes the file move at GLACIER pace & there’s nothing we can do about it 😭

@schizesq Good luck! Just remember that you will almost certainly know the case better than the judges (as you should), so think of your argument as a conversation with the bench and an opportunity to help them better understand the issues on appeal.

@zachary_aman This is an interesting question if the party is pro se. I think it’s clearly discoverable if it’s a party that is otherwise represented.

Hence my question of if that LLM use is discoverable.

@zachary_aman I ~almost~ sent a subpoena to ChatGPT recently but chickened out because I was afraid that my client also used it. It’s a two way street that I’m sure we’ll have to use cautiously. Though all bets are off for family law attorneys, I hear.

Have you guys seen/used discovery requests about the opposing party using ChatGPT or other LLMs to "talk about" their case? With the recent cases coming out that those records aren't privileged, I feel like they could be a big source of discovery disputes.
