Read the statute. It is straight forward.
Section (a)(7) makes it a crime to commit any act of violence on a mass transit vehicle.
End of section.
There is no aspect of the offense that requires any "terrorism" aspect.
The statute was adopted in 2006 -- five years after 9/11. It replaced a statute that was directed at train derailments -- that had nothing to do with "terrorism".
It helps to understand the law if you want to comment on the law.

This is the same kind of unlawful stretch of a criminal statute that was used on Trump and J6 defendants. Section 1992 is an Antiterrorism statute. This was not terrorism aimed at disrupting a transit system, it was murder. Bondi would have a better go charging him under Section 1111 and claiming it's a civil rights violation for the federal nexus. That too is a stretch. Or charge both. Either way, there's a decent chance of dismissal. Worth trying? Probably. Sometimes you win even when you lose. The best part is that double jeopardy doesn't preclude state and federal charges for the same actions. Look for an insanity defense.
