The claim that the Government was “taken to court and lost” is incorrect.
The matter did not proceed to a court judgment. The statutory mechanism in question was withdrawn by the Government after receiving legal advice from King’s Counsel. Following that opinion, the proposed course of action was reconsidered and the process halted before any court ruling took place.
This was not a case that was heard and won in court. It was a decision taken in light of senior legal advice, prior to judicial determination.
