The Fifth Circuit's ruling to remove Tornado Cash from OFAC's sanctions list is a direct stab at the Government's recent regulation by enforcement strategy. Here are the most important arguments: 1. The court has found that Tornado Cash smart contracts do not constitute a service or property, defining the contracts as tools that are "nothing more than lines of code," which cannot be sanctioned under current OFAC regulation. 2. The court has found that Tornado Cash does not own or control the smart contracts, as the developers revoked any role in the software's operation – making important distinctions between "mutable", which it defines as custodial, and "immutable" software. 3. The court recognizes that OFAC's framework may be outdated to apply to modern technologies, but explicitly states that it "declines the Department's invitation to judicial lawmaking", stating that "Legislating is Congress’s job—and Congress’s alone."

A judge just ruled that Tornado Cash is to be removed from the OFAC sanctions list. This is hugely good news for anyone developing privacy software and will likely have a positive impact on Roman Storm's trial, where it is debated whether the court may criminally charge the developers of software. s/o to all the people that fought for our right to privacy on this ❤️

⚠️ I see a lot of fake info being spread about Monero in relation to this leaked video from Chainalysis. Just to sum it up. Monero is NOT broken/traceable/honey pot whatever. Chainalysis is using spy nodes to correlate IPs to user's transactions, and attempting to corroborate it with other info (like IPs) from other parties to attempt to trace where funds have gone, as well as using tools to make guesses on eliminating decoys. By watching this video, you will see just how hard this is to do, and how ultimately ineffective this will be for 99% of transactions, especially as Monero's privacy improves. Simply avoiding their spy nodes and using your own node will put stop to them linking your IP to a tx, aswell as masking your IP when using swap services. Tracing transactions forward will only become infinitely harder once FMCP is rolled out. If I'm missing anything here, feel free to chime in.

I’m in camp re-brand for mweb. We need to be in the habit of explaining what these things do, not how they function. 99% of people don’t get what a blockchain is; much less an extension block. Telegram has full access to all of the content of group chats and regular one-to-one chats due to lack of end-to-end encryption. Their opt-in secret chats use homegrown end-to-end encryption with weaknesses. Deleting the content from the app likely won't remove all copies of it.
