Breaking 📰: Appeal Court Rules on Kenya Film Ban That Targeted “Rafiki” Kenya’s Court of Appeal has delivered a judgment in the case that began when the Kenya Film Classification Board (KFCB), Kenya’s film regulator, banned “Rafiki” in 2018. “Rafiki” is a Kenyan feature film directed by Wanuri Kahiu that includes a romantic relationship between two women, and the KFCB blocked it from public screening on “public morality” grounds. Eight years later, in its January 23, 2026 judgment, the Court struck down parts of the "Film and Stage Plays Act" and said censorship decisions must follow Kenya’s Constitution and its protections for freedom of expression. The Court said a film that depicts a same-sex relationship can be classified for age, including an “adults only” rating, and it also limited when police or appointed officers can intervene “by force” during filming, and rejected a legal provision that allowed the state to keep removed parts of a film. In essence: the Court ruled that the government cannot block a film solely because it shows a same-sex relationship, and that such films can be shown under age-based classification rules, subject to the Constitution.
