Haitian TPS Termination (February 2026) She issued an 83-page opinion temporarily blocking the Department of Homeland Security from ending Temporary Protected Status (TPS) for roughly 350,000 Haitians. The termination was set to take effect on February 3, 2026. Reyes found the decision was “substantially likely” motivated by “hostility to nonwhite immigrants,” lacked proper agency consultation, and was not based on reasoned decision-making about conditions in Haiti. She later denied the government’s motion to stay her order pending appeal, keeping the protections (work authorization and deportation relief) in place while litigation continues. TPS remains in effect while the Supreme Court considers the emergency stay request. Activist judges like her are undermining the will of the voters and the rule of law.
