After years of putting my life on the line defending Israel, calling out every blood libel and every terror apologist, yesterday’s Knesset vote has finally broken me. They just passed a death-penalty law for convicted terrorists “with blood on their hands.” I’ve spent my entire adult life arguing Israel is better than this. Turns out I was wrong. This isn’t self-defence. This is the moment we became what our enemies always claimed we were. I can’t defend it anymore. Not today. Not ever again. The mask is off.

Today, Israel's Knesset passed a death penalty law for terrorists. It may sound good, but in practice this is a stupid and unnecessary law. It's a political stunt that won't improve security or deliver justice, and could instead cause real diplomatic damage to Israel. The first problem is that the law is structured in a way that makes it almost impossible to apply in practice - in military courts, where Palestinians from the territories are tried, it creates a track in which the death penalty is effectively the default punishment for an act of terrorism that results in death. In civilian courts, by contrast, prosecutors would've to prove that the murder was committed with the intention of 'denying the very existence of the State of Israel'. That's an almost absurd standard in criminal law. How exactly is anyone supposed to prove something like that at the level of certainty required when the punishment is death? Suppose an attacker says he acted out of revenge, religious ideology, or some personal grievance. Does that count as a desire to erase Israel? Is a general anti-Zionist statement enough? Does hatred of Jews automatically amount to an intention to destroy Israel? The law places judges in a deeply gray area, and in a criminal system that requires an especially high threshold of proof, there'll almost always be reasonable doubt. In other words, they came up with a formula that's meant to sound aggressive without openly saying what's really behind it. Instead of drafting a precise criminal statute, they produced a vague slogan. And even if someone imagines that this will lead to a wave of executions, that simply doesn't match reality - the law itself still leaves judges room to avoid imposing the death penalty for special reasons. Beyond that, Israel has barely used capital punishment at all since the execution of Eichmann in 1962. So the likelihood that this law will meaningfully change sentencing in practice is extremely low. In most cases, as before, courts will continue handing down life sentences or other punishments. In practical terms, the benefit is close to zero. The potential cost, however, could be very real: This law gives perfect ammunition to anyone trying to portray Israel as a state that applies different systems of justice based on national identity. Human rights organizations, European governments, international bodies, and the Palestinians already know exactly how to use it: discrimination, violations of the laws of war, and breaches of principles of international law. Even if some of these claims are exaggerated, the diplomatic and public-relations damage could still be real. And for what? Not for a serious improvement in security, and not because this is a smart legal measure, but mainly to create the appearance of being "tough". It's a law that's unlikely to change reality, but is very likely to generate headlines and triumphant posts from politicians who want to claim they did something. In the end, this ties directly into the criticism I, and many right-wing Israelis like me, have of the current government: instead of investing in steps that could actually improve security, deterrence, and the functioning of state institutions, they keep choosing performance over substance - a lot of theater, very little content, no real certainty that it'll improve deterrence, and a high chance of dragging Israel into legal and diplomatic complications. It's simply exhausting.

Because of an unbelievable delay, not only is the mandatory service not being extended to 36 months, but in a few months it’s actually going to be shortened to 30 months. The IDF is deployed along lines not seen since the Six-Day War, but with a mandatory service suited for world peace.

@RabbiPoupko You could read a history book. Palestinians killed very few people in 1948 because they had no army. The Arab armies did kill som Israelis - mostly soldiers - but the Israelis killed even more Arab soldiers - as well as many civilians.

The Palestinians of Jericho are by far descendants of the Arab Al-Ghawarna tribe who were a mixture of Turks and Egyptians sent there on the orders of the Ottomans. The Palestinians of Bethlehem are by far the descendants of the Ghassanids who arrived from Yemen centuries after Jesus. To claim they are related to "10,000 years of Jericho history" or to Jesus is ridiculous.
