.@lualaba35005 is right my friend. 1. The State owns all land in DRC which obviously includes Manono territory. 2. The State creates, awards, approves transfers, terminates, amends, and can extinguish all permits and concessions that confer use rights on the land (like mining exploration, mining, building a structure, logging, etc) based on provisions in its Mining, Forest, and Land Codes. 3. According to the Ministry of Mines, AVZ violated the Mining Code on account of development delays- specifically, Art 71 and 197. And DRC's courts ruled in two separate cases AVZ forged its share certificate and that shares were illegally transferred- leading to its state-owned JV partner, Cominiere, to take full ownership in the old permit, which was later split in two. All of these actions were in accordance with DRC law. Now, obviously (and rightfully) AVZ disputes the revocation of its exploration/research permit but in terms of the basic facts about DRC law re its land, resource permit/concession authority, and the AVZ case, @lualaba35005 is correct.

$AvzManono is not private property. In the DRC, subsoil resources belong to the State. A mining permit grants the right to develop a project under legal obligations, not ownership of the lithium. If those obligations are not met, the State can lawfully reassess the permit.

I am fully and completely confident that KoBold has made offers to AVZ that not only compensate it and its shareholders of its costs up to this point but also a premium. In the event AVZ management fails to disclose any material offer and is sued by shareholders (particularly, institutional American ones) an Aussie Judge, as part of his/her evidence gathering and review of the offer, will determine if it was fair value.

KoBold Metals could face courtroom drama or prolonged legal headaches similar to AVZ Minerals' saga—if the underlying governance and corruption issues in Kinshasa aren't fully addressed.
