Traditional marriages are legally recognised under the Recognition of Customary Marriages Act of 1999. Once lobola is paid, you are legally married. If no antenuptial contract was signed before lobola was paid, this means that if you jointly own a house and get divorced, you guys remain halvies on the house. Whether Home Affairs paperwork exists or not is irrelevant. That is the part almost nobody plans for. If you want to protect your real estate assets, an antenuptial contract must be signed before the lobola ceremony concludes. The Black Coffee divorce tested this in court, and just yesterday the Constitutional Court confirmed it: antenuptial contracts signed after a customary marriage are not valid.
