Easy. Subject to the jurisdiction' in the 1860s meant full political allegiance, not just 'can be arrested.' Drafters like Sen. Howard explicitly excluded children of foreign diplomats, invading armies, and those owing allegiance elsewhere. Wong Kim Ark involved legal Chinese residents under treaty rights with domicile, not illegal entrants. The Court noted their parents were 'resident' with permission. It doesn't stand for birth + illegal presence = citizenship. The 14th was for freed slaves with no foreign ties. Early practice and original meaning didn't grant automatic citizenship to children of illegal aliens or temporary visitors. SCOTUS can clarify the original public meaning without rewriting text. Proper fix for policy isn't ignoring history.

@SteveWeigel @JBlunt1018 I’ll raise ya another one that I’d like you to chew on for a bit: are tourists subject to US law? Say a pregnant woman gets a tourist visa, enters the country legally, and does not overstay, but gives birth while here. Could her baby have US citizenship? If not, why not?

I would appreciate it if you argued in good faith. Update was not the best word choice. Clarify the extent of the application of the amendment. Is that better? We have done similar things with other ammendments. I and many legal scholars believe the first sentence implies that if your parents are citizens of another nation and subject to their laws, then when you are born you are subject to the same laws.

@SteveWeigel @JBlunt1018 SCOTUS does not have the power to “update” amendments (that would literally be amending the Constitution), nor do they have the leeway to ignore or misinterpret the text. The text of 14A does not mention legal permanent residence. SCOTUS doesn’t get to pretend that it does.

Updating ammendments which had/have a clear purpose to address modern problems is totally appropriate. When the amendment was written, the problem of mass illegal immigration wasn't on anyone's radar. Many legal experts do not agree that "Subject to the jurisdiction thereof" is plainly saying that means you get citizenship. If I were to bet what the SCOTUS will say it would be, anyone who is here illegally (visa overstays, illegal crossing, etc.) will not qualify and people with permanent residence or better will qualify. To me that seems not only very lkke, but very fair.

@SteveWeigel @JBlunt1018 That would be a spectacular deviation from over a century of precedent, not to mention the plain text of 14A. This interpretation would basically be amending the Constitution & would open up the door for SCOTUS to make similar nonsensical “distinctions” for other rights

What Nick Cannon said is exactly how misinformation spreads. Yes, the KKK was tied to Southern Democrats in the 1800s. That part is true. But leaving out what happened next changes the entire meaning. In the 1960s, after Lyndon B. Johnson passed the Civil Rights Act of 1964 and the Voting Rights Act of 1965, the racists who supported segregation did not just disappear… They left the Democratic Party and shifted politically. That is a huge part of the story that keeps getting left out. AND THAT MATTERS. Because when we, especially Black voices with big platforms, repeat half stories, it does not just stay a conversation. It spreads and it can be used against us. We cannot afford to be loud and wrong at the same time, especially right now.
