In today's standard paper, I ask; 1. Given that a judge holds office by reason of his capacity to reason, can a judge then err in reasoning? 2. I ask whether a judge is permitted to use a particular school of jurisprudence as a fixed and determinative position 3. Does the constitution combine the various schools of legal reasoning (jurisprudence)? 4. Does the constitution have a framework for legal reasoning (a basic structure for reasoning)? In today's Standard newspaper, I argue that; 1. Once a judge has all the facts, all the issues, and the applicable law, there is only one legitimate direction; forward, through reason, to a conclusion that those inputs can honestly support. A judge who arrives somewhere else must explain how he got there, and the record must be capable of providing that explanation. 2. Decisional independence doesn't mean applying the law mechanically. It means applying the correct legal reasoning for the correct output. 3. Decisional independence is the freedom to reason. It is not the freedom to abandon reason. 4. The Amani National Congress strongly condemns the excessive and unjustifiable force deployed by police officers against Hon. @edwinsifuna, Hon. @orengo_james, and other leaders who had gathered at Ufungamano House for a lawful political meeting. The officers' repeated attempts to block access to the venue and violently disrupt the proceedings were unnecessary, uncalled for, and a brazen abuse of state power. This conduct is a direct and serious violation of Article 38 of the Constitution, which guarantees every Kenyan the right to freely assemble, associate, and participate in political activities of their choosing. Using police to deny citizens — including elected leaders — access to a lawful meeting is not law enforcement. It is political suppression, and it must be condemned in the strongest terms. The ANC is deeply troubled by the pattern of state apparatus being weaponised to interfere in the internal affairs of political parties. Deploying police to disrupt opposition meetings is a hallmark of authoritarian politics, not a democracy. The country’s leadership must not seek to break and weaken political parties for short-term gain.
