The @NACDL filed an amicus brief calling this what it is: three constitutional crises. 1. The seizure of assets violated the Sixth Amendment right to counsel of choice. 2. Scripted grand jury testimony violated confrontation rights. 3. The fraud theory itself was legally defective.

Shah's appellate counsel told the panel: "We agree with Judge Kirsch. We have never seen anything like this." Allowing this would mean the government gets "a wholesale ability to draft grand jury statements and introduce them later" at trial. That's not justice.🏴‍☠️That's lawfare.

Oh, that's not the insane part… this is the insane part! When those witnesses deviated at trial after being confronted with irrefutable documentary evidence?🦹🏻The government read back the scripted grand jury testimony instead.

Judge Michael Scudder put it plainly to the prosecution: The government made the error - then placed the burden on Shah to "figure out the consequences" and "sort it all out." "How is that a fair or proper outcome here?"🧐 Good question.

The problems here are extraordinary. Judge Easterbrook pressed the DOJ attorney on why the government's "admitted asset over-restraint" shouldn't require reversal.
