And now he's the head of Homeland Security. Think of it this way: Extend Chief Justice Roberts’ analogy of judging to umpiring as he explained it at his confirmation hearing. In that frame, what happened here is pitcher Jack Smith got the Judge/umpire to come over to the mound. Smith said, “I’m going to throw a fastball right down the middle for my next pitch, what do you think?” and the Judge/umpire said “That sounds great.
