@ProfJessieSmith I am writing to you as I read your blog from August 27th, 2012, titled Explaining the Defendant's Absence at Trial. Mack Perry was wrongfully convicted and is innocently awaiting appeal while incarcerated. There are many dynamics to the case that were most assuredly handled improperly. The question that I had was in regard to his inability to be present at the reading of the verdict. I would greatly appreciate it if I could discuss this with you. I have also sent you an email. His name is Mack Perry. This is his account. 6th amendment violated and ignored! Please read below! I am writing this post with a pained and heavy heart. Mack is unavailable to write it himself as he is currently in the Ohio Reception Center for inmates after being wrongly convicted and with zero evidence. Mack is an innocent man sitting unable to eat and suffering unnecessarily. The facility he is at has been kind, understanding and most assuredly attempting to assist with his medical needs. When in the county jail until this past Wednesday he had barely eaten. He has eaten 4 times in 30 days due to the unavailability of a renal diet. The facility he is in now is trying to work with the dietary provider to accommodate his dietary needs, but he is still very ill and very innocent. It is simply through grace that he is still alive. Mack does not share publicly such things as his history of a stroke in 2002, the TIA he had this April, or the Stage 3 kidney disease that he continues to battle. The jail he is in is only capable of providing what they have. They are working with what they can. He has specific medical needs and is dying in jail for a crime he most assuredly did not commit. He has lost such an extreme amount of weight in 30 days that I fear he does not have long to live. I believe he is dying. I am asking for your prayers, your support and for your voice. We need to save Mack. He is not guilty. I beg you as I write this post trembling with sadness and fear we need to ban together and raise our voices. Mack needs justice. Justice is his freedom. Justice is a new trial. That is all he wants. He wants a new and fair trial. We are working on acquiring a good appeals attorney as well as various other options in hopes of helping Mack be released from this nightmare he is caught in. We are working on Stay of Execution and Sentence with request for bond so he can fight this battle. There were various occurrences before, during and after the trial that were most assuredly violations of his rights. These too must be explored and thoroughly and properly addressed. One specifically that was violated was the 6th amendment Rule 43. Mack was not there for the reading of the verdict and didn't waive his right. He was taken to the hospital via ambulance after having an attack, possibly a seizure, and was not able to do so. The verdict was still delivered without his presence. Mack has always shown everyone around him kindness and generosity. This is truly who he is. I know this personally. He has supported so many in so many ways. Please we must get #justiceformack!
