I’ve been thinking this week about Brian Tingley: a Christian counselor who challenged Washington state’s viewpoint-based counseling ban in 2021. At the time, challenging a counseling ban felt like a cultural “third rail”—especially for a blue state counselor with a reputation to uphold. But Brian knew the harm that would come to families if these bans were upheld. So he sued. Tingley lost at the district court, then at the 9th Circuit. When @ADFLegal appealed to the Supreme Court, three justices favored taking Brian’s case—just one vote shy of a cert grant. Justices Thomas and Alito wrote dissents from the cert denial, noting the importance of the issue—and the fact that it wasn’t going away. They were right. Two years later, we appealed a near-identical case from Colorado: Chiles v. Salazar. This time, the Supreme Court took the case. And just this week, the Court referenced Tingley in its Chiles opinion, ruling 8-1 that Colorado’s counseling ban was an “egregious assault” on First Amendment principles. “The Constitution does not protect the right of some to speak freely; it protects the right of all.” Sometimes—oftentimes—you have to lose before you can win. And no one can predict when the win will come. It’s a matter of simply stepping out in boldness and faith to do what’s right, come what may. I’m deeply grateful to every ADF client who makes that choice—whether they walk the path of Brian Tingley or Kaley Chiles. Win or lose, they stand up. They set their comfort aside. They challenge injustice. It’s people like this who will keep America free.

On Easter morning, April 5, nearly 20 protesters gathered in the green space on Summit Avenue in front of the entrance to Cities Church. They held signs with obscenities and yelled harassing comments at families and individual worshippers. Among them was a speaker blasting music and amplified sound, and at least one protester who used a voice-amplifying device to harass people. After the St. Paul Police Department issued several warnings related to the noise, they arrested one individual. I am grateful for SPPD’s measured response and their efforts to protect the congregation’s ability to gather and worship peacefully. While similar protests have continued in recent weeks, the people of Cities Church have sought to respond with patience and kindness.  I am disheartened that the charges against the individual arrested yesterday have been dropped. State law protects the right of people of faith to worship in peace, and I call on state and local officials to enforce the law. But the most important thing is that the gospel remains unchanged: God so loved the world that he gave his only Son, that whoever believes in him should not perish but have eternal life. That invitation is open to all.

Brian Tingley, a counselor in WA state, blazed the trail that led to this victory. SCOTUS declined his case in Dec 2023, but he was vindicated today. Grateful for men and women who stand for freedom. And for @ADFLegal who stands with them. Congrats!

One point must be emphasized regarding Finland’s “hate speech” conviction of Päivi Räsänen.   It’s natural to assume Finnish laws won’t affect Americans. But under the EU’s Digital Services Act, social media platforms must abide by the “hate speech” standards of any EU member state—meaning the most censorial states set the standard. Not just for Europe, but worldwide.   Today Finland showed us how such “hate speech” standards play out: with the silencing of sincere Christian beliefs. But under a DSA-controlled internet, those standards are enforced quietly. Not through the courts—where one can at least mount a legal defense—but through shadow bans and deplatforming, all mandated by the DSA’s sprawling censorship apparatus.   The EU has made itself the world’s secret speech police. We can’t let this continue. That’s why @ADFLegal attorneys in the U.S. and internationally are providing support for @X’s legal challenge against the DSA. The DSA must go.

Excellent move by @BlackRock: ending religious discrimination in its employee gift-match program. As @NoahRNash writes in @townhallcom, this didn’t happen by accident—it followed substantive engagement with @ADFLegal and conservative shareholders pushing for common-sense reform. Too many companies have let far-left groups like the SPLC distort charitable giving through third-party administrators like Benevity. BlackRock chose a better path. The lesson is the same everywhere. These laws do not survive proper scrutiny. Slovenia rejected it. The Leadbeater bill is stalling. And now Scotland has said no. The more people see, the more they turn against them and chose to protect life and the vulnerable.
