Washington state relies on an honor system when registering to vote to attest eligibility rather than requiring applicants to submit documentary proof of U.S. citizenship or other eligibility criteria at the time they register. A person in Washington state does not have to show a birth certificate, passport, naturalization papers, or any other citizenship document when registering to vote. The only ID needed is for identity verification is a Washington driver’s license/ID number or last 4 digits of SSN. A person who lies on the form commits a Class C felony with a penalty of up to 5 years in prison and/or $10,000 fine. Currently, no one person verifies eligibility at the time a person registers to vote. The SAVE America Act, a Republican-backed bill mandating documentary proof of U.S. citizenship for federal voter registration, Cantwell claims would disenfranchise millions of eligible voters without addressing rare cases of fraud. According to the Heritage Foundation’s Election Fraud Database, there have been seven documented criminal convictions for voter fraud in Washington state since 2000: - Clifton Eugene Mitchell (2007): False registrations (part of a large ACORN voter registration fraud case in Seattle, described by the Secretary of State as one of the worst in state history). - Jayson Woods (2007): False registrations. - Ryan Olson (2007): False registrations (pleaded guilty to two felony counts of providing false information on voter-registration applications). - Susan Risenhoover (2009): Criminal conviction (specific fraud type not detailed in summary listings). - Janice Waters (2010): Duplicate voting and fraudulent use of absentee ballots (convicted of illegal registration in the wrong county, absentee ballot fraud, and double voting; submitted a ballot for her ineligible son). - Donald L. John Ley, candidate Niko Battle, and former Councilman Josh Binda all faced formal residency challenges in Washington state between 2022 and 2025 filed by opponents or residents and reviewed by county auditors or courts under state law and local charters. Each involved allegations that the claimed residence was not their true or qualifying address—Ley used a friend’s home for $1/month rent; Battle and Binda faced questions tied to evictions, alternate addresses, or insufficient proof of district residency. Ley, a Republican, was disqualified from ballot for incorrect address which led to 2023 felony charges that were resolved Feb 2025 with misdemeanor “attempted voter violations” plea (suspended jail, probation, $500 fine). He successfully re-ran and won in 2024 using a valid new address (separate 2024 challenge dismissed) and is now serving as state representative. Battle, Everett City Council District 4 candidate in 2025, won his Primary winner but court challenge succeeded disqualifying him from the general-election ballot. Binda's 2025 voter-registration challenge was dismissed by Snohomish County Auditor after Binda presented a valid Lynnwood address after his previous voter registration address was never confirmed.

Yesterday I signed a bill prohibiting double voting by fixing an ambiguity in state law. Voting more than once in an election is an affront to everyone who participates in our democracy. This bill makes it clear that double voting is illegal. Those who try it will be held accountable. Thanks to the Secretary of State for requesting this bill, and to sponsor Sen. Cortes.

Footage Shows 28 Instances Of Cash Changing Hands For Ballot Signatures & Voter Registration Forms. Many of the petitioners had no understanding of the petitions’ purpose they were advertising. Circulators also instructed individuals to use fake addresses. “Oh, you can just fake an address.” Weingart Center, which received hundreds of millions in public funding, is on tape directing people to where the fraudulent petitioners are located, and directing homeless individuals to petitioners & coaching plausible deniability. “See they say ignorance is no excuse for the law. But a lot of times, I have to say ‘I didn’t know, I had no idea.’” We encountered 28 instances of petitioners offering cash, cigarettes, and marijuana for signatures on petitions. On camera, one petitioner said, “We have one that taxes billionaires 5%. One-time tax. 5% and that’s gonna go towards healthcare.” Other petitions sought to overturn LA’s $30 minimum wage for hotel and airline workers. Paying per signature and encouraging fake addresses violates federal and state election law and is proof of fraud happening in California. Weingart employees were caught directing the homeless to the location of the petitioners and coaching them on plausible deniability. Intake coordinator Jason Warren told an undercover journalist exactly where and when to find them: “Most time they be right across the street, under that tree… Monday through Friday.” In 2016, nine individuals were arrested on Skid Row for exchanging cash and cigarettes for signatures; in 2019 they were charged on 14 counts under the exact same California Elections Code section. Yet when confronted, nearby LAPD officers dismissed the activity as “a civil lawsuit.” “Paying per signature violates state election law and is evidence of election fraud in California,” the investigation concludes. Nothing is more important than the integrity of our elections. The conduct and allegations captured on video undermine confidence in our election system here in California. Under 52 U.S.C. § 10307(c), it is a federal crime to provide false information on a voter registration form or to offer payment to complete a voter registration form. While longstanding DOJ policy prevents me from discussing specific investigations, I want to assure the public that this DOJ, under the leadership of @AGPamBondi, will aggressively pursue anyone and everyone involved in violating federal election laws.
