Not accurate, learned counsel. El-Rufai was arraigned and he pleaded not guilty to the charges. The ICPC is merely a custodial facility in respect of the order of remand. As the prosecuting agency, it cannot operate outside the jurisdiction of the court. The court is seised of the case. There is no longer allowance in law for administrative bail. The government cannot show compassion outside the due process of law. How many Nigerians who are facing prosecution have been shown similar compassion? By releasing him, they’ve prejudiced the bail application before the court slated for hearing on 31st March, 2026. This singular action lends credence to two facts, namely: (i) the government views their case against him as primarily political, (ii), Nigeria is a lawless country.

The Court didn’t remand El Rufai in prison custody, it remanded him in ICPC custody on the application of the ICPC (I believe) pending their investigation. I believe the ICPC can grant him administrative bail if they deem it necessary on “compassionate grounds”. In fact, I won’t be surprised if it’s just for a few days. Nonetheless, the argument that the ICPC lacked the power to grant him administrative bail without a court order is reasonable but it is not in totality. I believe the ICPC still has discretion on his bail unless he was remanded in prison custody.

You would rather take five hundred naira than protect your dignity because of begging. And there is no group of people who engage in this sycophancy more than the Hausa. When a person returns from Abuja, you follow him all the way to his house shouting; there is even celebratory gunfire (harbin kuliya). You follow him like dogs, and then you say you want peace.
